2. Acceptance of Terms

By accessing our Website or engaging our Services, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions.

You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are acting on behalf of a company or organisation, you confirm that you are authorised to do so.

If you do not accept these terms, please do not use our Website or engage our Services.

3. Description of Services

Munkhong Rak provides pension legal advisory services in Thailand, including the following:

  • Pension Review Session (฿2,600) — an advisory session reviewing pension circumstances and available options, with a written summary provided.
  • Formal Response Preparation (฿5,100) — preparation of formal responses and supporting documents for engagement with pension authorities.
  • Long-Term Legal Partnership (฿8,600) — ongoing support for extended or complex matters, with agreed scope and regular updates.

Services are available to individuals located in Thailand. Availability and scope are subject to the specific circumstances of each matter. Nothing on our Website constitutes legal advice until a formal engagement has been agreed.

4. User Responsibilities

When using our Website or Services, you agree to:

  • Provide accurate and complete information when submitting enquiries or engaging our services.
  • Not use the Website for any unlawful purpose or in any way that could harm Munkhong Rak or third parties.
  • Not attempt to copy, reproduce, or systematically extract content from the Website.
  • Not submit false or misleading information in connection with a pension matter or formal response.
  • Cooperate reasonably with our team throughout the provision of services, including responding to requests for documents or information in a timely manner.

5. Intellectual Property

All content on the Website, including text, design, structure, and materials, is the intellectual property of Munkhong Rak or our licensors. You are granted a limited, non-exclusive licence to view and download content for your personal use only.

You may not reproduce, distribute, or use our content commercially without prior written consent. Documents we prepare on your behalf are provided for your use in connection with your matter only.

6. Fees & Payment

Our service fees are presented in Thai Baht (฿) as listed on the Website. Fees apply to the service as described. Where the scope of a matter changes, we will discuss any adjustment with you before proceeding.

  • Payment terms for each service will be confirmed in writing at the start of the engagement.
  • For the Long-Term Legal Partnership, costs are discussed and agreed in advance, with updates provided throughout.
  • Refunds are considered on a case-by-case basis and will reflect the work completed to the point of any request to end an engagement.

All quoted amounts are inclusive of applicable taxes unless stated otherwise.

7. Service Delivery Terms

We undertake to provide our services with reasonable skill and care. However:

  • The progress and outcome of a pension matter depend in part on factors outside our control, including decisions made by regulatory authorities.
  • Timelines are estimates and may be affected by the responsiveness of third parties or changes in your circumstances.
  • We will keep you informed of progress and consult you before any significant decision is taken on your behalf.
  • Any change in the scope of services will be agreed with you in writing before it takes effect.

8. Confidentiality

We treat all client information with discretion. Information shared with us in the context of your matter will not be disclosed to any third party except as required to perform the service, as required by law, or as you specifically authorise.

We ask that you also treat any advice, documents, or strategy we prepare for you as confidential.

9. Disclaimers

The content of our Website is provided for general information purposes only. It does not constitute legal advice and should not be relied upon as such without seeking a formal consultation.

We make every effort to ensure the accuracy of information on our Website, but we do not warrant that it is complete, current, or free from error. Regulatory requirements and legal processes may change.

Our services are provided on the basis that we will exercise professional care and judgement — not that any particular outcome will be achieved.

10. Limitation of Liability

To the fullest extent permitted by Thai law, Munkhong Rak's liability arising from or connected with the provision of services shall not exceed the fees paid for the specific service giving rise to the claim.

We are not liable for indirect, consequential, or incidental losses including loss of income, loss of opportunity, or any loss arising from reliance on third-party decisions (such as rulings by pension authorities).

Nothing in these Terms excludes liability for fraud or wilful misconduct.

11. Indemnification

You agree to indemnify Munkhong Rak against any claims, costs, or damages arising from your breach of these Terms, your misuse of our Website, or the provision of inaccurate information that affects the conduct of your matter.

12. Termination

Either party may conclude an engagement by providing written notice. Where you choose to end an engagement, fees for work already completed will be due. We will provide a clear account of work undertaken up to that point.

We reserve the right to decline or discontinue providing services in circumstances where we reasonably believe that continuing to do so would not be in your best interests or would place us in a professionally untenable position.

13. Dispute Resolution

These Terms are governed by the laws of Thailand. In the event of a dispute, we encourage you to contact us first so that we can seek a resolution directly and informally.

If a satisfactory resolution cannot be reached, disputes will be subject to the jurisdiction of the courts of Chiang Mai, Thailand.

14. General Provisions

  • Entire agreement: These Terms constitute the full agreement between us regarding the use of the Website, supplemented by any written engagement agreement for specific services.
  • Severability: If any provision of these Terms is found unenforceable, the remainder of the Terms continue in full force.
  • Waiver: Our failure to enforce any provision at a particular time does not constitute a waiver of that provision.
  • Assignment: You may not transfer your rights or obligations under these Terms without our prior written consent.

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised "Last Updated" date. Continuing to use our Website or Services after an update constitutes acceptance of the revised Terms.

We recommend reviewing this page periodically. Material changes affecting active engagements will be communicated to clients directly.
